TERMS AND CONDITIONS OF SALE

These conditions apply to all offers and contracts relating to the sale and delivery of B&G Concept Store Goods. In other words, the Buyer agrees to comply with these conditions when ordering one or more goods from the B&G Concept Store Website (bngrsconceptstore.it).

REQUIREMENTS FOR ENTERING INTO A CONTRACT WITH B&G PROJECTS SRL

To purchase a Good through the B&G Concept Store website (bngrsconceptstore.it), you must be over 18 years of age.

PURCHASE METHODS AND TERMS OF SALE

1. After viewing a product "Example code no. 17D004-1", you can proceed with the order by clicking on the "ADD TO CART" button.

2. At the end of your order, click on the "VIEW CART" button.

6. The summary of your order will appear in the cart. You can delete items in the cart using the cross icon. You can empty the cart using the "X" button or add other items. Finally, click on "Check-out".

7. You will move to a new field where you will be asked to enter your personal data.

If you have already registered on the website before placing the order, you can log in by clicking on "Log in".

If you want to ship the goods to another address, check the box "SHIP TO A DIFFERENT ADDRESS".

9. After verifying the shipping address, you will be asked to recheck the size entered for your goods and you will be given the option to re-download the document for checking the sizes for BnG Real Shoes items.

You will also be asked to accept the general terms and conditions of the contract and the privacy policy for the website.

10. You will be asked to choose the payment method. Check the box with your preferred payment method. Payment methods are:

ONLINE CREDIT CARD PAYMENTS. Transactions take place in a secure environment. All cards with VISA, VISA ELECTRON, MASTERCARD, CARTASI-PAYPAL circuits are accepted.

Upon receipt of the credit notification, we will proceed with the creation of the personalized shoe as ordered and then with the shipment of the purchased GOODS.

11. After choosing the payment method, click on "CONFIRM ORDER". You will receive an email with the summary of your order, detailing all ordered items and the payment method used. If you choose "ADVANCE BANK TRANSFER" payment, you will need to print the order summary you receive via email, which will include the bank details for the advance transfer. It is very important to include the order number (found in the summary you receive via email) and the name and surname of the person who placed the order in the reason for the bank transfer.

TRANSPORT

Transport is entrusted to our trusted courier. Upon receipt of the goods, the customer must check that the number of packages matches the number indicated on the waybill and that the goods are not damaged. In case of breakage, the customer must refuse the damaged package and return it to the courier. The courier, upon delivery, must issue a copy of the waybill to the customer, where the quality and quantity of the rejected goods will be noted. A copy of this letter will then be forwarded by the customer for information to B&G Concept Store by letter or email to: info@begprojects.com

The goods travel at our risk. The costs of returning damaged goods and redelivering the replacement package are borne by B&G Concept Store.

TRANSPORT COSTS

Transport costs will be entirely borne by the buyer.

DELIVERY TIMES

The goods are shipped via traditional courier.

Average delivery times: 2 weeks.

For particular problems related to home delivery and for customers who are difficult to find at home due to work reasons, we recommend requesting the free telephone notification service before delivery, by selecting the appropriate icon in the personal data entry section.

Delivery will be made as soon as possible and, in any case, within thirty days from the date of conclusion of the contract, subject to any impediments due to force majeure or other causes beyond the control of the parties.

CONTRACT FOR THE SALE OF GOODS

1. PREMISE

The following conditions govern the contractual relationship between the company B&G Concept Store (VAT number 03888110230) with registered office in Viale dell'industria, 37, 37015 Sant'Ambrogio di Valpolicella 37015 VR. Tel +39 045 683 8406, email info@begprojects.com, in the person of its legal representative Emanuele Guardini (hereinafter Concept Store) and the natural or legal person (hereinafter: buyer) who purchases goods (hereinafter: the GOODS) promoted by Concept Store via the Internet. Any modification to this contract must be necessarily accepted in writing by Concept Store.

2. METHOD OF CONTRACT CONCLUSION

All terms and conditions contained on the B&G Concept Store website are to be understood as an invitation to offer, or terms and conditions aimed at allowing the buyer to send a specific contractual proposal.

Therefore, only at the end of the selection procedure and after having read the general information, the buyer may send B&G Concept Store the purchase proposal for the goods. B&G Concept Store reserves the right to accept or reject such proposal. In case of non-acceptance, nothing will be due to the buyer, who declares from now on to waive any claim for compensation or indemnity against B&G Concept Store.

In case of acceptance, B&G Concept Store will send the buyer an order confirmation message (hereinafter: acceptance) containing the contractual conditions.

The order confirmation will be sent by B&G Concept Store via email.

3. PRICE

The price of the goods subject to the contract is that indicated in the purchase proposal sent by the buyer, as resulting in the acceptance.

The price is inclusive of VAT (for EU countries) and free on arrival, excluding shipping costs as resulting from the purchase proposal and order confirmation.

4. ELECTION OF ELECTRONIC DOMICILE

The buyer declares to elect their electronic domicile at the email address indicated in the purchase proposal and, therefore, hereby gives their consent for all communications to be sent to the aforementioned address.

The buyer undertakes to communicate in writing any change in the aforementioned electronic domicile.

5. PAYMENT

The buyer undertakes to make payment of the price as indicated in the purchase proposal and acceptance.

Ownership of the goods will, in any case, only pass to the buyer after payment of the price from the buyer to B&G Concept Store.

6. DELIVERY

Upon receipt by B&G Concept Store of the due price, the latter will proceed with the packaging and delivery of the goods by courier or postal shipment. The buyer is, however, required to verify with the competent customs authorities the absence of any import limitations on the goods. B&G Concept Store cannot be held responsible for any import prohibitions provided in the destination state of the purchased product.

Delivery times are approximately 2 weeks.

Delivery will be made in any case as soon as possible and, in any case within 2 weeks from the date of conclusion of the contract.

However, the terms are not binding.

The parties agree that any impediments due to force majeure or other causes beyond the control of the parties are reserved.

7. IMPEDIMENTS

If, after payment of the price by the buyer and before delivery, force majeure or other causes beyond the control of B&G Concept Store occur that prevent the latter from delivering the goods, the amount paid will be returned to the buyer within 15 days of receiving the order, applying a deductible of 5.00 Euro.

8. WARRANTY

B&G Concept Store guarantees that the contractual goods comply with current Italian legislation. The legal guarantee of conformity on purchased goods is also recognized pursuant to articles 128-135 of the Consumer Code (Legislative Decree no. 206/2005), if the buyer is a consumer, and pursuant to articles 1490 et seq. of the Civil Code if the buyer is a professional.

9. EXCLUSION OF THE RIGHT OF WITHDRAWAL

9.1 The goods subject to this contract are considered custom-made and clearly personalized goods pursuant to Article 59, paragraph 1, letter c) of the Consumer Code.

Therefore, the right of withdrawal referred to in Article 52 of the Consumer Code does not apply to the aforementioned goods.

10. RETURN OF GOODS

B&G Projects guarantees the buyer the possibility to request the replacement of  only some of the purchased goods. In particular, the return policy will apply only to the models indicated and consultable on the page bngrealshoes.com/return-policy/,  The replacement of the product cannot in any case be requested for error in the size of the product.

The goods must be returned or delivered in their original packaging, intact, unused, unworn, unwashed, undamaged and accompanied by the identification tag or label or attached seal. B&G Concept Store cannot accept returns for  goods where returns are possible if the aforementioned conditions are not properly met and if the label or sticker or seal are not intact and attached to the goods. In particular, the goods must not show obvious signs of use, other than those compatible with a normal try-on of the item, and therefore must not bear traces of prolonged use (beyond a few minutes) exceeding the time necessary for a try-on, and must not be in a state that prevents their resale.

11. PRIVACY (G.D.P.R. (EU) 2016/679)

The buyer's personal data will be processed in accordance with EU Regulation 2016/679, fully effective from May 25, 2018, according to the methods precisely indicated in the Information on the processing of personal data (pursuant to art. 13 of Legislative Decree 196/2003).

12. GENERAL INFORMATION

1. The goods covered by the contract, the price with taxes and duties, delivery costs, payment methods, as well as existing assistance services and commercial guarantees are described in the "contract for the sale of goods" conditions.

4. The buyer may exercise the right of withdrawal according to the legal terms mentioned above.

6. B&G Concept Store will not be responsible for any anomalies, interruptions, suspensions of the Internet network, nor for the content of any hyperlinked and unauthorized websites.

7. The publication, dispatch, or transmission, in any form, even if partially modified, of the content of the site, and therefore of images, texts, sounds, codes, etc., is not permitted.

These General Terms and Conditions of Sale are governed by and must be interpreted exclusively in accordance with Italian law, and the Court of Verona shall have exclusive jurisdiction over any dispute, without prejudice to the applicability of mandatory legal provisions and jurisdiction established to protect Consumers.

15. LANGUAGE

This transaction document is drafted in Italian and translated into English. The parties agree that any interpretative dispute arising from this document must be resolved according to the meaning that the legal terms used have in the Italian language.

European consumers purchasing through our website or online with our company are advised that they may resolve any dispute relating to and/or arising from sales contracts for goods and services entered into with our company, through alternative online dispute resolution (ODR) systems as provided at the link: http://ec.europa.eu/consumers/odr/.
