TERMS OF SALE

These terms apply to all offers and contracts relating to the sale and delivery of Goods by B&G Concept Store. In other words, the Buyer agrees to comply with these terms when ordering one or more goods from the B&G Concept Store website (bngrsconceptstore.it).

REQUIREMENTS FOR ENTERING INTO A CONTRACT WITH B&G PROJECTS SRL

To purchase a Good through the B&G Concept Store website (bngrsconceptstore.it), you must be at least 18 years old.

HOW TO PURCHASE AND TERMS OF SALE

1. After viewing an item "Example code no. 17D004-1", you can place an order by clicking the "ADD TO CART" button

2. At the end of your order, click on "VIEW CART".

6. Your order summary will appear in the cart. You can remove items from the cart using the cross icon. You can empty the cart using the "X" button or add more items. When finished, click "Check-out".

7. You will move to a new page where you will be asked to enter your personal details.

If you have already registered on the website before placing the order, you can log in by clicking "Sign in".

If you want the goods shipped to a different address, tick the box "SHIP TO A DIFFERENT ADDRESS".

9. After verifying the shipping address, you will be asked to double-check the size entered for your items and will be given the option to download the sizing guide for BnG Real Shoes products.

You will also be asked to accept the general terms and conditions and the privacy policy for the website.

10. You will be asked to choose the payment method. Tick the box for your preferred payment method. The available payment methods are:

ONLINE CREDIT CARD PAYMENT. Transactions take place in a secure environment. All VISA, VISA ELECTRON, MASTERCARD, and CARTASI-PAYPAL cards are accepted.

Upon receipt of payment confirmation, we will proceed with preparing the shoe as ordered and then ship the purchased GOODS.

11. After choosing the payment method, click "CONFIRM ORDER". You will receive an email with a summary of your order, including the details of all items ordered and the payment method used. If you choose payment by "ADVANCE BANK TRANSFER", you must print the order summary you receive by email, which will include the bank details for making the advance transfer. It is important to state the order number found in the email summary, together with the full name of the person who placed the order, in the payment reference.

SHIPPING

Shipping is entrusted to our trusted courier. Upon receiving the goods, the customer must check that the number of parcels matches the number stated on the waybill and that the goods are not damaged. In the event of breakage, the customer must refuse the damaged parcel and return it to the courier. At the time of delivery, the courier must provide the customer with a copy of the waybill noting the quality and quantity of the goods refused. A copy of this document should then be forwarded by the customer to B&G Concept Store, by letter or email, at: contacts@bngrealshoes.com

Goods travel at our risk. The costs of returning damaged goods and of reshipping a replacement parcel are borne by B&G Concept Store.

SHIPPING COSTS

Shipping costs are entirely borne by the buyer.

DELIVERY TIMES

Goods are shipped via standard courier.

Average delivery time: 2 weeks.

For specific home-delivery issues, or for customers who are hard to reach at home for work reasons, we recommend requesting the free telephone notice service before delivery, by selecting the relevant option in the personal details section.

Delivery will be made as soon as possible and, in any event, within thirty days of the date the contract is concluded, subject to any impediments due to force majeure or other causes beyond the parties' control.

CONTRACT FOR THE SALE OF GOODS

1. INTRODUCTION

These terms govern the contractual relationship between the company B&G Projects Srl (trading name: B&G Concept Store / BnGRS Concept Store) (VAT/Tax ID IT03888110230), with registered office at Viale dell'Industria, 37, 37015 Sant'Ambrogio di Valpolicella (VR), Italy, tel. +39 045 683 8406, and retail store at Padiglione degli Ufficiali, Via della Serenissima, Peschiera del Garda (VR), Italy, tel. +39 045 450 0725, email contacts@bngrealshoes.com, represented by its legal representative Emanuele Guardini (hereinafter "Concept Store") and the natural or legal person (hereinafter "the buyer") who purchases the goods (hereinafter "the GOODS") offered by Concept Store via the Internet. Any amendment to this contract must be accepted in writing by Concept Store.

2. HOW THE CONTRACT IS CONCLUDED

All terms and conditions contained on the B&G Concept Store website constitute an invitation to treat, allowing the buyer to submit a specific contractual offer.

Therefore, only after completing the selection process and reviewing the general information, the buyer may submit a purchase offer for the goods to B&G Concept Store. B&G Concept Store reserves the right to accept or decline that offer. If the offer is not accepted, nothing shall be owed to the buyer, who hereby waives any claim for compensation or indemnity against B&G Concept Store.

If the offer is accepted, B&G Concept Store will send the buyer an order confirmation message (hereinafter "acceptance") containing the contractual terms.

The order confirmation will be sent by B&G Concept Store by email.

3. PRICE

The price of the goods covered by the contract is the price stated in the purchase offer sent by the buyer, as reflected in the acceptance.

The price is VAT included (for EU countries) and free on arrival, excluding shipping costs, as reflected in the purchase offer and order confirmation.

4. ELECTION OF ELECTRONIC DOMICILE

The buyer declares that they elect their electronic domicile at the email address provided in the purchase offer, and therefore consents in advance to receive all communications at that address.

The buyer undertakes to notify in writing any change to that electronic domicile.

5. PAYMENT

The buyer undertakes to pay the price as indicated in the purchase offer and the acceptance.

Ownership of the goods passes to the buyer only after payment of the price by the buyer to B&G Concept Store.

6. DELIVERY

Upon receipt of the amount due, B&G Concept Store will package and deliver the goods by courier or postal shipment. The buyer is, however, required to check with the competent customs authorities that there are no import restrictions on the goods. B&G Concept Store cannot be held responsible for any import restrictions applicable in the destination country of the purchased product.

Delivery times are indicatively set at 2 weeks.

Delivery will in any case be made as soon as possible, and in any event within 2 weeks of the date the contract is concluded.

These time frames are not, however, binding deadlines.

The parties agree that any impediments due to force majeure or other causes beyond the parties' control are excepted.

7. IMPEDIMENTS

Should force majeure or other causes beyond B&G Concept Store's control arise after payment of the price by the buyer and before delivery, preventing delivery of the goods, the amount paid will be refunded in full to the buyer within 15 days of receipt of the order, with no deduction whatsoever.

8. WARRANTY

B&G Concept Store warrants that the contractual goods comply with the regulations in force in Italy. The statutory warranty of conformity on purchased goods is also recognised pursuant to Articles 128-135 of the Italian Consumer Code (Legislative Decree No. 206/2005), where the buyer qualifies as a consumer, and pursuant to Articles 1490 et seq. of the Italian Civil Code where the buyer is a professional.

9. RIGHT OF WITHDRAWAL

9.1 If the buyer qualifies as a consumer under the Italian Consumer Code, they have the right to withdraw from this contract within 15 days of receiving the goods, without giving any reason, in accordance with the procedures described in the Refund Policy published on the Site.

9.2 Pursuant to Article 59 of the Italian Consumer Code, only goods made to the consumer's specifications or clearly personalised for them are excluded from the right of withdrawal. This exclusion does not apply to standard catalogue products, even if available in multiple colour or size variants.

10. RETURN OF GOODS

The return of goods follows the procedures and terms described in the Refund Policy published on the Site, which forms an integral part of these terms: withdrawal within 15 days of receipt, return of the goods intact, in their original packaging and with original labels, via a trackable shipping service; return shipping costs are borne by the buyer, except in the case of defective or non-conforming goods, for which the statutory warranty referred to in Section 11 applies and return costs are borne by B&G Projects Srl.

11. PRIVACY (G.D.P.R. (EU) 2016/679)

The buyer's personal data will be processed in accordance with EU Regulation 2016/679, fully in force as of 25 May 2018, as described in detail in the Privacy Policy (pursuant to Article 13 of Legislative Decree 196/2003).

12. GENERAL INFORMATION

1. The goods covered by the contract, the price including taxes, delivery costs, payment methods, and any existing after-sales services and commercial warranties are described in the terms of the "contract for the sale of goods".

4. The buyer may exercise the right of withdrawal in accordance with the statutory terms set out above.

6. B&G Concept Store shall not be liable for any anomalies, interruptions or suspensions of the Internet network, nor for the content of any linked, unauthorised third-party websites.

7. Publication, transmission or distribution, in any form, even partially modified, of the website's content — including images, text, sounds, code, etc. — is not permitted.

14. GOVERNING LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by and shall be interpreted exclusively in accordance with Italian law, and any dispute shall fall under the exclusive jurisdiction of the Court of Verona, without prejudice to any mandatory consumer-protection provisions of law and jurisdiction.

15. LANGUAGE

This document is drafted in Italian and translated into English. The parties agree that any interpretative dispute arising from this document shall be resolved according to the meaning of the legal terms used in the Italian language.

16. ONLINE DISPUTE RESOLUTION FOR CONSUMERS

European consumers who purchase through our website are advised that they may resolve, out of court, any dispute relating to or arising from the sales contracts for goods and services entered into with our company, through the online dispute resolution (ODR) systems as provided at the following link: http://ec.europa.eu/consumers/odr/.

Using these systems, while optional for the consumer, may lead to the resolution of disputes without the need for court proceedings.
